MyStones Terms & Conditions
Please read these T&Cs and conditions carefully

1. Purpose
1.1. These terms (together with any documents referred to herein, including those set out in paragraph 3.1) (these “T&Cs”) set out the terms conditions on which you may make use of:
1.1.1. this website (https://mystones.ch/) (the “Website”) and any content we provide to you through the Website;
1.1.2. the MYSTONES mobile application, the data supplied within such application and any updates or supplements to it (the “App”) and any content we provide to you through the App; and
1.1.3. any other products, services and/or platforms we operate now and at any time in the future,
(together, the “MYSTONES Services”).
1.2. These T&Cs will be posted on our Website and will be available for you to access and read through our App too.
2. Our details
2.1. The MYSTONES Services are owned and operated by MYSTONES GROUP Sàrl (registered number CHE-171.122.858) of Chemin du Bochet 18, 1024 Ecublens, Vaud, Switzerland (“MYSTONES”, “us”, “we”, “our”).
2.2. To contact us, email us at contact@mystones.ch. You may also provide any feedback, questions and complaints relating to the MYSTONES Services via this email address.
3. Other terms that may apply to you
3.1. The following additional T&Cs will also apply to your use of the MYSTONES Services:
3.1.1. our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us; and
3.1.2. our Cookies Policy, which sets out the cookies and tracking technologies we use on the MYSTONES Services.
3.2. The way in which you can use the App may also be controlled by the rules and policies of the Google Play Store and the Apple App Store in force from time to time.
4. Acceptance of these T&Cs
By using any of the MYSTONES Services, you confirm that you accept these T&Cs and that you agree to comply with them. If you do not agree to these T&Cs, you must not use the MYSTONES Services.
5. Your access and registration to MYSTONES Services
5.1. Our Website is made available to you free of charge.
5.2. In order to access certain areas or features of the MYSTONES Services, you must be a registered user. When you register as a user of MYSTONES Services, you will be asked to select whether you are an athlete (an “Athlete User”) or a coach (a “Coach User”) (the Athlete User and the Coach User, together a “User”). If you wish to register, then we require you to provide us with, at minimum, your full name, date of birth, email address. Your registration as a User and the areas or features you have access to may also depend on your Subscription to the MYSTONES Services. Each individual may only create one User account for personal use only.
5.3. You must be 14 years of age or older at the time of registration (or such higher age as may be required in your jurisdiction) to access and use the App (or, as applicable, certain other areas or features of the MYSTONES Services). If you are under the age of 18, your parent or legal guardian will need to complete your registration on your behalf. If you are a parent or legal guardian of a User, you agree to be fully responsible for the acts or omissions of such User, including any breach of these T&Cs. We always reserve the right to refuse access to the MYSTONES Services by Users under the legal age, at our sole discretion.
5.4. If you choose, or you are provided with, a User log-in name, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any User ID or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these T&Cs.
5.5. Whenever you make use of a feature of any of the MYSTONES Services that allows you to submit information to us for use in the MYSTONES Services (including in the case of Profile Content, as defined and referred to in paragraph 6), you warrant that: (i) all such information is true, accurate and not misleading; and (ii) we have the right to rely on that information and include it (at our discretion) in the MYSTONES Services.
6. Uploading content to, and use of, App features
6.1. In order to use certain features in the App: (i) as an Athlete User, you may upload to your profile on the App, your full name, age, gender, area of discipline (e.g. sprinter, long distance runner, pole vaulter, etc.), weight, gender, profile picture (and other information which may become optional to upload at the point of registration or in the future); or (ii) as a Coach User, you may upload to your profile on the App, your full name, age, gender, area of discipline (e.g. sprinter, long distance runner, pole vaulter, etc.), weight, gender, profile picture (and other information which may become optional to upload at the point of registration or in the future) (together, the “Profile Content”). As a User, you grant MYSTONES a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of display, and perform that Profile Content in connection with any of the features, content and/or services provided on the App (and any other MYSTONES Services, as applicable). Such rights shall expire when you delete the Profile Content from the App.
6.2. All Profile Content must comply with the standards and restrictions set out in paragraph 7. MYSTONES will determine, in its sole discretion, whether Profile Content breaches the standards and restrictions set out in paragraph 7.
6.3. You must ensure that you have the right to use the Profile Content, to upload it to the App and to permit us to use it in accordance with these T&Cs. If a Coach User wishes to upload any Profile Content relating to an Athlete User, the Coach User must always obtain the Athlete User’s consent. In the case where such Athlete User is under the age of 18, the Coach User must obtain consent from such Athlete User’s parent or legal guardian.
6.4. You are responsible for updating any Profile Content that you upload and ensuring it remains accurate.
6.5. We may remove Profile Content without notice if we believe it does not comply with these T&Cs.
6.6. You acknowledge that we have no control over content, information or materials that may be uploaded or shared by other users of the App (and any other MYSTONES Services, as applicable), including any content that may be offensive, inappropriate, obscene, unlawful or otherwise objectionable.
6.7. An Athlete User may grant permission to share any data on their profile by linking their profile with a Coach User. Once linked with the account of the Athlete User on the App, the Coach User will be able to:
6.7.1. view and modify any training data of the linked Athlete User;
6.7.2. view training progress indicators of the linked Athlete User;
6.7.3. view readiness and load exposure in respect of the linked Athlete User; and/or
6.7.4. monitor multiple Athlete Users via the dashboard function on the App.
6.8. Coach Users will not be able to access certain features or details of a linked Athlete User, such as period monitoring features, or pictures or videos of a linked Athlete User, unless the linked Athlete User has granted access to the same.
6.9. We also use a third party API partner, Tilastopaja, which synchronises and imports any performance data from competitions or events an Athlete User participates in that is available on their systems onto the profile of an Athlete User on the App, provided the Athlete User authorises such synchronisation in their personal settings on the App. Information collected by Tilastopaja will be subject to their own terms and policies. We are not responsible for the terms or policies of Tilastopaja.
6.10. We may also integrate Athlete User profiles with the third party platform provider, Strava, provided the Athlete User authorises such integration in their personal settings on the App and any other applicable permissions requested by Strava. If authorised, the Athlete User will be able to synchronise certain training activities recorded on Strava (such as session type, distance, duration or other available performance metrics) with their Athlete User profile and import such data onto their Athlete User profile on the App. We do not control and are not responsible for the services, policies or practices of Strava. All Athlete Users should review any applicable terms and conditions and policies of Strava before authorising this integration.
6.11. Without prejudice to our rights under paragraph 15 if you breach these T&Cs, we may also suspend or remove your access to the MYSTONES Services at any time without notice, including in response to a security incident.
7. Content standards and acceptable use policy
7.1. You may use the MYSTONES Services only for lawful purposes. You may not use the MYSTONES Services, or any content on it, or upload any Profile Content:
7.1.1. in any way that breaches any applicable local, national or international law or regulation or in contempt of court;
7.1.2. in a way that breaches any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
7.1.3. in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
7.1.4. in a way that is defamatory, obscene, offensive, hateful or inflammatory to any person;
7.1.5. for the purposes of promoting sexually explicit material;
7.1.6. for the purposes of promoting violence or any illegal content or activity;
7.1.7. for the purposes of harming, abusing or attempting to harm or abuse minors in any way;
7.1.8. for the purposes of impersonating any other person or misrepresenting your identity or affiliate with any other person;
7.1.9. to bully, insult, threaten, embarrass, cause inconvenience or needless anxiety, alarm, annoy, intimidate or humiliate any person or any actions which are likely to do the same;
7.1.10. to promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
7.1.11. to upload terrorist content or to encourage or induce acts of terrorism;
7.1.12. to collect or harvest any information or data from the MYSTONES Services or attempt to decipher any transmissions to or from the servers hosting any of the MYSTONES Services; and
7.1.13. to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
7.2. You also agree:
7.2.1. not to reproduce, duplicate, modify, copy or re-sell any part of the MYSTONES Services, including any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text, in contravention of the provisions of these T&Cs;
7.2.2. not to access without authority, interfere with, damage or disrupt:
(i) any part of the MYSTONES Services;
(ii) any equipment or network on which any of the MYSTONES Services are stored;
(iii) any software used in the provision of the MYSTONES Services; or
(iv) any equipment or network or software owned or used by any third party;
7.2.3. not to conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the MYSTONES Services for any purpose, including the development, training, fine-tuning or validation of AI systems or models; and
7.2.4. not to use, and we do not consent to the use of, the MYSTONES Services, or any data published by, or contained in, or accessible via, the MYSTONES Services for the purposes of developing, training, fine-tuning or validating any AI system or model.
8. Availability of the MYSTONES Services
8.1. We do not guarantee that the MYSTONES Services, or any content on any of the MYSTONES Services, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the MYSTONES Services for business and operational reasons, or if you breach these T&Cs.
8.2. We will not be liable to you if, for any reason, any of the MYSTONES Services are unavailable at any time or for any period or if your location is unavailable on any of the MYSTONES Services. You are responsible for obtaining the data network access necessary to use the MYSTONES Services.
8.3. We may update and change the MYSTONES Services from time to time to reflect changes to our users' needs and our business priorities, to improve performance, enhance functionality, reflect changes to the operating systems or address security issues. If you choose not to install such updates when such updates are made available in respect of the App or if you opt out of automatic updates to the App, you may not be able to continue using our App (or the App may have limited or interrupted functionality).
8.4. The MYSTONES Services require an active broadband internet connection or mobile network connection. The App requires an Android or iOS compatible device.
9. Viruses
9.1. We do not guarantee that the MYSTONES Services will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes, mobile devices and other platforms to access the MYSTONES Services. You should use your own virus protection software.
9.2. You must not misuse any of the MYSTONES Services by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to any of the MYSTONES Services, the servers on which any part of the MYSTONES Services are stored or any server, computer or database connected to the MYSTONES Services. You must not attack any of the MYSTONES Services via a denial-of-service attack or a distributed denial-of service attack. In the event of your breach of this provision of these T&Cs, your right to use the MYSTONES Services will cease immediately.
10. Intellectual property rights
10.1. You agree that we are the owner or the licensee of all intellectual property rights in the MYSTONES Services, and in all material we publish on them. Such works are protected by copyright laws and treaties around the world. All such rights are reserved. We grant you a limited, non-exclusive, non-sublicensable, revocable, non-transferable licence to access and use the MYSTONES Services and all material published on it on your personal device, in each case solely for your personal and non-commercial use. All other rights are reserved to us.
10.2. You will remain the owner of all intellectual property rights (such as copyright) in any data you share, upload or make available on the App (including Profile Content), provided you own such data you share, post or make available on the App and you have the legal right to use such data.
10.3. You agree that: (i) you shall not modify any of the materials you have downloaded in any way; (ii) you shall not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text or out of the context in which it is posted on the relevant part of the MYSTONES Services; (iii) you shall not make any adverse or derogatory comments about us or the MYSTONES Services and you shall not do anything which shall, or may, bring us or the MYSTONES Services into disrepute or harm our reputation in any way; (iv) our status (and that of any identified contributors) as the authors of the content on the MYSTONES Services must always be acknowledged; and (v) you must not use any part of the MYSTONES Services for commercial purposes without obtaining a licence to do so from us or our licensors.
11. Third party links
We may from time to time provide links to third party websites, apps or platforms as part of the MYSTONES Services, including Tilastopaja and Strava. We have no control over the third party websites, apps or platforms and accept no liability for any statements, information, content, products or services that are published on or may be accessible from those third party websites, apps or platforms. It is of utmost importance that you thoroughly check all information provided on the third party websites, apps or platforms before you commit to procuring any goods or services.
12. Linking to our Website
You may link to our Website home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. We reserve the right to withdraw linking permission without notice.
13. Suitability and accuracy of content on the MYSTONES Services
13.1. The content on the MYSTONES Services are provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the MYSTONES Services.
13.2. The MYSTONES Services are a place to connect our users virtually, in order to share experiences and information in a safe and positive way. We are a neutral party to any interactions between users, and we are not responsible for these interactions or any information shared between users, including any advice given by a Coach User to an Athlete User. We have no responsibility to confirm the identity of our users or any other information about them, such as qualifications, background, or abilities. You must always use common sense and good judgment when dealing with any of our other users.
13.3. Although we make reasonable efforts to update the information on the MYSTONES Services, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

14. Limitation of our liability
14.1. The MYSTONES Services are provided “as is” and “as available”. To the extent permitted by law, we exclude all conditions, warranties, representations or other T&Cs, which may apply to the MYSTONES Services or any content on them, whether express or implied (including, without limitation, any representation, warranty or guarantee regarding the reliability, timeliness, quality, suitability or availability of any services provided through the MYSTONES Services or of the quality, suitability, safety or ability of any service provider).
14.2. Nothing in these T&Cs excludes or limits our liability for unlawful intent or gross negligence, or any other liability that cannot be excluded or limited by law.
14.3. Subject to paragraph 14.2, we will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
14.3.1. the use of, or inability to use, any or all of the MYSTONES Services;
14.3.2. the use of, or reliance on, any content displayed on any part of the MYSTONES Services;
14.3.3. any transaction or relationship between you and any service provider;
14.3.4. any failure in performance for causes beyond our control; or
14.3.5. your connecting to any linked third party websites, apps or platforms or any statements, information, content, products or services that are published on, or may be accessible from, any linked third party website, app or platform.
14.4. Subject to paragraph 14.2, in addition, we have no liability to you for any:
14.4.1. indirect, incidental, special, exemplary, punitive or consequential damages;
14.4.2. loss of profit, loss of data, personal injury (not arising from our negligence) or property damage related to the MYSTONES Services or any services provided by our service providers; or
14.4.3. loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the MYSTONES Services or to your downloading of any content on it, or on any website linked to it.
14.5. Subject to paragraph 14.2, MYSTONES’ total liability to you whether in contract (including any warranty), in tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with these T&Cs shall not exceed the amount of Subscription Fees paid by you to us within the twelve (12) months preceding the event giving rise to the liability.
14.6. Nothing in these T&Cs shall affect your statutory rights as a consumer.
15. Breach of these T&Cs
15.1. When we consider that a breach of these T&Cs has occurred, we may take such action as we deem appropriate.
15.2. Your failure to comply with these T&Cs may result in us taking all or any of the following actions:
15.2.1. immediate, temporary or permanent withdrawal of your right to use the MYSTONES Services;
15.2.2. issue of a warning to you; and/or
15.2.3. disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
15.3. To the fullest extent permitted by law, we exclude our liability for all action we may take in response to breaches of these T&Cs. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.
16. Severability
Each paragraph (and sub-paragraph) of these T&Cs operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining paragraphs (or sub-paragraphs) will remain in full force and effect.
17. Applicable laws
17.1. These T&Cs, their subject matter and their formation, are governed by Swiss law. You and we both agree that the courts of Switzerland will have exclusive jurisdiction.
17.2. Notwithstanding paragraph 17.1, if you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are a resident, and nothing in these T&Cs, will affect your rights as a consumer to rely on such mandatory provisions of local law.
18. Changes to these T&Cs
We reserve the right to amend these T&Cs from time to time or change, update or discontinue any aspect or feature of the MYSTONES Services without notice. Every time you wish to use the MYSTONES Services, please check these T&Cs to ensure you understand the terms that apply at that time. Any changes we make to our T&Cs will be posted on our Website (which will also be available through the App) and, where appropriate, you will also be notified by email.
